Sayyed Gets STL Approval to Access Material in Hariri Case

Lebanon’s former General Security Chief Jamil As-Sayyed succeeded in getting the approval of the Special Tribunal for Lebanon to have access to certain materials in the case of the assassination of former Prime Minister Rafiq Hariri, including the false witnesses testimonies.

The Pre-Trial Judge in the Special Tribunal for Lebanon, Daniel Fransen, issued an order on Friday in which he determined that the Tribunal has jurisdiction to rule on Sayyed's application for access to certain materials in the case of the assassination of former Prime Minister Rafiq Hariri.

According to a statement issued by the tribunal, Fransen also decided that Sayyed had standing to address the Tribunal. However, after recalling that an individual's right to access his criminal file is a basic one, Judge Fransen noted that the exercise of this right could be limited, in particular where it might compromise ongoing investigations, undermine fundamental interests or affect national or international security.

“He then ordered Sayyed and the Prosecutor to submit to him, no later than 1 October 2010, their observations concerning the application of these limitations to the present case,” the STL statement said.

SAYYED REQUESTS REMOVAL OF STATE PROSECUTOR

Meanwhile, Sayyed requested that the Court of Cassation remove State Prosecutor Saeed Mirza, Police chief General Ashraf Rifi and Brigadier General Wissam al-Hasan from their posts.

A statement issued by Sayyed's office said he wants Mirza removed "due to the personal rivalry" between them.

Sayyed said his demand for the removal of Rifi and Hasan was that both men work as law enforcers under Mirza.
