Banning of Palestinian NGOs: How Israel Tries to Silence Human Rights Defenders

On October 21, Israeli Defense Minister Benny Gantz announced the issuance of a military order designating six prominent Palestinian human rights groups as ‘terrorist organizations’. Gantz claimed that they are secretly linked to the Popular Front for the Liberation of Palestine (PFLP), a socialist political group that Israel considers, along with most Palestinian political parties, ‘a terrorist organization.’

The Palestinian organizations included in the Israeli order are Addameer Prisoner Support and Human Rights, Al-Haq, the Bisan Center for Research and Development, Defense for Children Palestine, Union of Agricultural Work Committees (UAWC) and the Union of Palestinian Women’s Committees.

Considering the significance of these organizations in Palestine and their global networks among like-minded civil society organizations, the Israeli decision provoked a public outcry. One of the many statements of condemnation was a joint statement by rights groups, Amnesty International (AI) and Human Rights Watch (HRW), in which they called Gantz’s move an “appalling and unjust decision”, which represents “an attack by the Israeli government on the international human rights movement.”

Strong Words, but No Actions

AI and HRW, which have documented Israeli human rights violations of Palestinians for many years, fully understand that the ‘terrorist’ designation is consistent with a long trajectory of such unlawful moves:

“For decades, Israeli authorities have systematically sought to muzzle human rights monitoring and punish those who criticize its repressive rule over Palestinians. While staff members of our organizations have faced deportation and travel bans, Palestinian human rights defenders have always borne the brunt of the repression. This decision is an alarming escalation that threatens to shut down the work of Palestine’s most prominent civil society organizations.”

Equally important in the world’s leading rights groups’ statement is that it did not fail to highlight that the “decades-long failure of the international community to challenge grave Israeli human rights abuses and impose meaningful consequences for them has emboldened Israeli authorities to act in this brazen manner.”

True to form, the international community did react to Gantz’s decision, albeit it was the kind of ineffectual reaction, which persisted in the realm of rhetoric that is rarely followed by substantive action.

A joint statement by UN experts called the Israeli decision “a frontal attack on the Palestinian human rights movement, and on human rights everywhere”.

Michelle Bachelet, United Nations High Commissioner for Human Rights, criticized the “arbitrary” decision by Israel and warned of the “far-reaching consequences as a result,” in terms of work, funding and support for the targeted organizations.

Many governments around the world also condemned the Israeli move and echoed the sentiment conveyed by UN experts. Even the US expressed its ‘concern’, though, using the same typically cautious and non-committal language.

US State Department spokesman, Ned Price, told reporters on October 23, in Washington, that his country “believe(s) respect for human rights, fundamental freedoms and a strong civil society are critically important to responsible and responsive governance.” Instead of an outright condemnation, however, Price said that the US will “be engaging our Israeli partners for more information regarding the basis for these designations.”

However, like other governments, and certainly unlike AI and HRW, Price made no link between the Israeli decision of October 21 and numerous other past practices targeting human rights and civil society groups in Palestine and, more recently, in Israel as well. Also worth noting is that the supposed link between such organizations and the socialist PFLP is not new.

The following are a few examples of how Israel has attempted to silence some of these organizations, which, eventually were declared to be ‘terrorist.’

Raids, Arrests and Death Threats

Addameer – In December 2012, the Israeli army raided the headquarters of Addamer in Ramallah, confiscating laptops and a video camera. The offices of the Union of Palestinian Women Committees were also raided by Israeli occupation forces on the same day. The organization is one of the six now designated by Israel as ‘terrorist.’

In September 2019, Addameer’s offices were raided, once again. The Israeli military raid at the time, however, did not generate as much attention or outrage, despite the accompanying violence, let alone the blatant violation of human rights. Then, Al-Haq – also one of the other six effectively banned Palestinian groups – issued a statement warning that “the private property of human rights organizations in occupied territory is especially protected under Article 46 of the Hague Regulations (1907).”

Expectedly, such legal constraints mattered little to Israel.

Al-Haq – Al-Haq’s staff have faced many restrictions throughout the years. Shawan Jabarin, the General Director of Al-Haq, has been banned from travel on various occasions, starting in 2006.

In March 2009, Jabarin was prevented by Israel from traveling to the Netherlands to receive an award on behalf of his organization. Again, in November 2011, this time, Jabarin was now allowed to travel to Denmark.

The Israeli obstacles began taking even more sinister turns when, in March 2016, Jabarin began receiving death threats over the phone. These anonymous calls began arriving “in the context of increasing harassment of Al-Haq and its members, amid their recent work at the International Criminal Court (ICC) seeking justice for human rights violations being committed in the Occupied Palestinian Territories,” the Front Line Defenders website reported.

Defense for Children International-Palestine – In July, and again August 2021, Israeli forces raided Defense for Children International – Palestine (DCIP) offices in Al-Bireh, in the occupied West Bank. They seized computers, hard drives and other material, alleging a link between the organization and the PFLP.

This allegation had already been advanced in 2018, when UK Lawyers for Israel (UKLFI) persuaded Citibank and the Arab Bank PLC to stop providing banking services to DCIP, providing what they defined as “evidence of the close ties” to the PFLP.

While it is true that the recent Israeli measures against Palestinian NGOs are a continuation of an old policy, there are fundamental differences between the growing perception of Israel, now, as an apartheid state and the misconstrued perception of the past, namely Israel as an oasis of democracy.

Even international entities and groups that are yet to brand Israel an apartheid state are becoming familiar with the Israeli government’s undemocratic nature.

A ‘Tectonic Shift’

In December 2019, and after years of haggling, the ICC resolved that “there is a reasonable basis to proceed with an investigation into the situation in Palestine, pursuant to Article 53(1) of the (Rome) Statute.” Despite intense Israeli and western pressure, the last hurdle in the way of the investigation was removed last February, as the ICC has finally approved the Prosecutor’s request to open legal proceedings regarding war crimes in the occupied Palestinian territories, including Gaza.

This legal milestone was cemented by major declarations, one made by Israel’s own rights group, B’tselem, in January, and another by HRW in April, both slamming Israeli policies in Palestine – not just the occupied territories – as ‘apartheid’.

This critical change in the international legal position regarding Israel’s new, unflattering status, was boosted by Israel’s own violent actions in East Jerusalem, Gaza and throughout Palestine in May. Unlike previous wars, the May events have shifted sympathy mostly towards Palestinians, who are fighting for their freedom, homes and other basic human rights.

The change was also notable within the US government itself, which is unprecedented by any account. An increasing number of US lawmakers are now openly critical of the State of Israel, due to a radical change in the US public opinion and, again, unprecedently, they are not paying a heavy price for it as was often the case in the past due to the great influence of the Zionist lobby in Washington.

“The shift is dramatic; it’s tectonic,” the BBC, on May 21, quoted US pollster, John Zogby, as saying. “In particular, younger generations are considerably more sympathetic to the Palestinians – and that age gap has been on full display with the Democratic Party,” the BBC noted.

Israel’s losses are not just sentimental or political, but economic as well. Last July, the international ice cream giant Ben & Jerry’s decided to stop selling its products in illegal Jewish settlements while pinpointedly condemning Israeli occupation, a move that was described by Amnesty as “legitimate and necessary”. A few months later, the sports clothing manufacturer, Nike, followed suit, announcing that it will end the sale of its products in Israeli stores starting May 2022, although it did not justify its decision based on political reasoning.

While Israel continues to lash out at its critics, it no longer seems to behave according to a centralized strategy.

Lacking a strong leadership after the dethroning of former Prime Minister Benjamin Netanyahu and the formation of a diverse ‘unity government’, the new Israeli government does not seem capable of holding back international criticism of its conduct in occupied Palestine. The notion that everything that Israel does is justifiable as a form of ‘self-defense’ is simply no longer a strong selling point. The May war is the perfect example of this assertion.

In the case of the banned NGOs, for example, aside from sending a representative from the Israeli intelligence agency, Shin Bet, and another from the Israeli Foreign Ministry to Washington on October 25 with “relevant intelligence” to justify its decision, Tel Aviv continued to carry out the same policies that further exposes its apartheid in the eyes of the international community.

Indeed, on October 27, Israel announced the construction of thousands of new housing units in illegal Jewish settlements, in its first such move during the presidency of Joe Biden.

A perfect illustration of the frantic nature of the Israeli response came on October 29, when the Israeli envoy to the United Nations, Gilad Erdan, during his speech at the General Assembly, tore into pieces a report issued by the UN Human Rights Council illustrating Israeli ongoing violations of international law.

“The Human Rights Council attacked and condemned Israel in 95 resolutions compared to 142 resolutions against the rest of the world,” Erdan said. “This distorted and one-sided report’s place is in the dustbin of anti-Semitism,” he ranted.

Branding Israeli Apartheid

We may be at the cusp of a fundamental change in terms of Israel’s relationship with the international community. While Tel Aviv continues to heavily invest in its apartheid infrastructure, the international community is slowly, but clearly, becoming aware that Israel’s apartheid status is a permanent one. The successive statements by B’Tselem, HRW, the joint HRW-Amnesty statement condemning the de facto outlawing of the Palestinian NGOs and, again, the ICC investigation are all indicative of this growing awareness.

The question remains – will Israel be able to use its power, influence and leverage in Western societies to force the world to accept and co-exist with a full-fledged apartheid regime in Palestine? And if yes, then, for how long?

The South African apartheid example showed that, despite decades of apartheid and initial acceptance, if not support, by western societies of legalized racial separation in South Africa, the pendulum eventually turned. Even before the formal end of apartheid in that country in 1994, it was becoming clear that the days of the racist regime of Pretoria were numbered. That realization was possible because of the growing international awareness, especially at grassroot, civil society level, of the evil of apartheid.

A similar scenario seems to be evolving in the case of Israeli apartheid in Palestine as well. A critical mass of support for Palestinian rights is being constructed around the world, thanks to the Boycott, Divestment and Sanctions (BDS) movement and hundreds of pro-Palestine civil society groups all around the globe.

For years, Israel seemed keen on countering the influence of Palestine’s solidarity around the world using a centralized strategy. Large sums of money were dedicated, or pledged, towards that end, and a partly government-controlled company was even established, in 2017, to guide the Israeli global campaign. Much of this has amounted to very little, however, as BDS continues to grow, and the conversation on Palestine and Israel is gradually changing from that of a political ‘conflict’ into recognition of Israeli racism, apartheid and utter disregard of international law.

Of course, it will take more time, more decided effort and, certainly, more sacrifices on the part of Palestinians and their supporters to expose Israeli apartheid to the rest of the world. Now that Israel seems to have accepted that there is little it can do to reverse this brand, it is accelerating its colonial efforts, while hunkering down for a long fight ahead.

The onus is now on the international community to force Israel into dismantling its apartheid regime. Though it is ultimately the people who liberate themselves, international solidarity is essential to the process of national liberation. This was the case in South Africa, and will surely be the case in Palestine, as well.

Since its founding in 1948, the “State of Israel” has promoted an intense campaign to erase Palestinian history, culture and resistance on all its fronts. Human rights organizations such as the Boycott, Divestment and Sanctions Movement (BDS) and activists around the world are the constant targets of this attack.
Recently, “Israel” attacked the Palestinian human rights movement head-on, designating six non-governmental organizations (NGOs) as “terrorist groups” with the aim of silencing, restricting and interrupting the work they are doing. If human rights NGOs are “terrorists”, how should we identify the “State of Israel” guilty of violations of humanitarian law, war crimes, crimes against humanity and apartheid?

Watchdog: Nachshon repression unit attacked Qadiri

The Committee of Detainees’ and Former Detainees’ Affairs said members of Nachshon’s repression unit attacked Ya’qoub Qadiri, one of six Gilboa escapees, after his latest court hearing. His lawyer said more than 20 guards attacked him, threw him to the ground and stepped on his handcuffs, causing injuries to his right hand.
The commission added that the Israel Prison Service (IPS) refused to send Qadiri to the prison clinic.

It added that the IPS also continues to hold Qadiri in solitary confinement in Rimonim Prison with Israeli dangerous criminal prisoners. His cell is not fit to live and is guarded around the clock.

‘Israel’ dismantles, confiscates Palestinian barn under construction in Hebron

Israeli occupation forces dismantled and seized an under-construction sheep barn in Palestine at Masafer Yatta in the city of Hebron in the occupied West Bank earlier on Monday.
Local sources said earlier today that Israeli forces have escorted bulldozers into the area and have begun dismantling an under-construction barn owned by Palestinians before it is seized.

Israeli soldiers on Monday raided two communities near the town of Yatta, south of the southern West Bank city of Hebron, dismantled and confiscated a barn and kidnapped a Palestinian.
Fuad al-Amour, the coordinator of the Protection And Steadfastness Committee in Masafer Yatta and the southern hills of Hebron, said several Israeli military vehicles invaded the village of Erfa’eyya, dismantled a barn and seized it.

B’Tselem: ‘Israel’ uses settler terror as a tool to steal Palestinian land

Israeli authorities are using settler terrorist attacks as “an important informal tool” to take over Palestinian land in the occupied West Bank, Israel’s B’Tselem said.
In a report released Sunday, the major Israeli human rights group said the occupying state uses two main methods to steal Palestinian land in the West Bank: official annexation through its legal system and unofficial acts of intimidation and violence by the settlers. to drive native Palestinians from their homes.
“The state fully supports and assists these acts of violence, and its agents sometimes participate directly in them,” the report said.

B’Tselem: Israel is embezzling West Bank land due to settler violence

Israeli settlers injure three Palestinians near Nablus

Israeli settlers on Monday attacked many Palestinian farmers near the village of Burqa, north of the northern West Bank city of Nablus, injuring three.
Ghassan Daghlas, a Palestinian official who oversees Israel’s illegal colonialist activities in the north of the West Bank, said settlers attacked Palestinian farmers on their land near the Jenin-Nablus main road, throwing rocks at them.
Daghlas added that a Palestinian identified as Nasser Hijja suffered a facial injury after a settler threw a stone at him.

Israeli settlers on Monday attacked Palestinian farmers near the village of Burqa north of Nablus, in the northern occupied West Bank, injuring at least three people, according to local sources.
Ghassan Daghlas, who monitors Israeli settlement activities in the north of the West Bank, said in a press statement that Israeli settlers stoned Palestinian farmers while on their land in the village of Burqa, injuring at least three people.
One of the farmers was attacked in the face with a stone, another was injured after being hit on the head, while the third farmer was bruised.

At least 50 olive trees burned by Israeli settlers in Hebron

Israeli settlers on Monday set fire to more than 50 Palestinian olive trees in the town of Ash-Shuyukh northeast of Hebron, in the occupied southern West Bank, according to local sources activist Ahmad al-Halayqa.
The activist reported in a press statement that settlers set fire to at least 50 mature olive trees and set up two mobile homes on Palestinian-owned land next to the illegal Israeli settlement of Asfar, in an apparent prelude to taking the land for the benefit of settlement expansion.

Israeli ambassador to the UK, Tzipi Hotovely, was rushed out of the London School of Economics amid protests condemning her appearance.

“Israel’s” ambassador to the UK, Tzipi Hotovely, was rushed out of an event at the London School of Economics Tuesday, as protests formed on campus condemning her appearance.

Politics For All, a UK Political account on Twitter, posted a video of the evacuation, showing Hotovely being rushed out into a car as crowds chanted “shame on you!”

Hotovely had been invited by the LSE’s student union to take part in a debate, sparking controversy, as pro-Palestine groups at the school accused the student union of giving a platform to racism.

The Israeli occupation’s ambassador is a member of Benjamin Netanyahu’s Likud party and is a supporter of the occupation’s settler colonialist practices. She has also used Islamophic rhetoric on numerous occasions.

No evidence to back up Israeli claims

The occupation has also recently designated 6 Palestinian NGOs as “terrorist organizations,” sparking condemnation from various human rights groups and EU countries.

Five European members of the UN Security Council revealed Tuesday their serious concerns over the Israeli move. France, Estonia, Ireland, Norway, and Albania released a joint statement on the matter.

“Israel” has failed to provide evidence to convince European officials that the 6 NGOs were linked to the PFLP or “violent activities”, as they claimed.

Saudi Arabia Has It All Figured Out in Lebanon – As It Had With the War in Yemen!

Beirut – Saudi Arabia is escalating its aggression against the nearly completely devastated and ravaged Lebanon. The so called kingdom of goodness is venting its anger and expressing its frustration because of its humiliating defeats in Yemen. Hence it has exhausted all possibilities in other places; Lebanon continues to function as a venue for Riyadh to send its poisonous messages through!

Nonetheless, these messages will definitely fall on deaf ears, as the world is busy in other places and more important issues, and the Kingdom of Saudi Arabia [KSA] will have to wait  for years before it could restore little of dignity, if any!

The Ansarullah or better known as the Houthis have put the kingdom into shame as its military, regardless of all the support it is receiving, has been receiving devastating blows from the Yemenis.

Aside of all its heavy loss, the hotheaded Saudi leadership continues to carry out its merciless war against the Yemenis with no slightest opportunity to win a battle, let alone the war.

The continuous massacres and war crimes by the Saudi forces and its backers have not been able to break the will of the Yemenis to fight and they have been able to achieve real victories across the whole front.

The United States and the United Nations, as many other governments, have dubbed the war as absurd and futile.

Many governments in the world have called upon Riyadh to put an end to the war without any positive answer from the latter.

The Saudi government, in its struggle to draw the attention to its dilemma and big plight in Yemen, has chosen Lebanon as a mail box to send messages to the West, namely the US.

The Americans are busy minding other issues and would not accept any further political turmoil in Lebanon as they are organizing groups of so called civil society and NGOs, and orchestrating efforts to win the majority in the next parliamentary elections due in the few coming months.

Saudi Arabia is exercising pressure on Lebanon and blackmailing the government to force minister of information George Kordahi to resign because of an opinion about the Saudi war against Yemen that he expressed before assuming his office.

The Kingdom threatened to severe relation with Lebanon and to send tens of thousands of Lebanese citizens working there back to Lebanon.

Not only that, but Riyadh has also forced other gulf countries to adopt similar positions against Lebanon.

This Saudi pressure has been shamefully supported by many Saudi-financed Lebanese media outlets and Lebanese parties and figures. Many of the Lebanese tools who work for Saudi Arabia have sided with Riyadh against their country and government calling for its resignation.

This attitude of vengeance by the Saudis was not well received by the French government which still believes that Lebanon should have a government to be able to address its dire situation.

As such, the Saudi pressure will not substantiate any successful possibility to bring the government down, and if it otherwise did, then Riyadh will be held responsible for all the repercussions and consequences that will come after.

Lebanon would wait for friendly countries to support and help in one of its most dangerous critical situations and not like what the Saudis did by pressuring it.

A time for the Lebanese to contemplate about who their real friends are and who are their adversaries and opponents.

Whatever the case is; Saudi Arabia who was defeated in Yemen will not win in Lebanon. Definitely!

UN: “Israel’s” Classification of Palestinian NGOs As Terrorist “Arbitrary”

The United Nations says “Israel” is putting human rights defenders at risk with their decision to designate several Palestinian NGOs as terrorists based on no evidence.

“Israel’s” designation of 6 prominent Palestinian civil society groups as outlawed “terrorist organizations” is an unjustified attack, Michelle Bachelet, the United Nations Commissioner of Human Rights, said Tuesday.

The Israeli occupation had classified last week 6 Palestinian NGOs as “terrorist,” attributing their baseless decision to said organizations “financing the Popular Front for the Liberation of Palestine.”

Bachelet said the decision was an attack on human rights defenders, on freedoms of association, opinion and expression, and the right to public participation, calling for the move to be immediately revoked.

“Anti-terrorism legislation” should be applied to legitimate human rights and humanitarian aid activities, she asserted.

“The organizations… face far-reaching consequences as a result of this arbitrary decision, as do the people who fund them and work with them,” she said.

The NGOs “Israel” designated terrorist have been delivering humanitarian aid to Palestinians harmed by the Israeli occupation and who’ve had their human rights abused in the occupied territories.

The commissioner argued the decision would have “a chilling effect” on human rights defenders.

“The crucial work they perform for thousands of Palestinians risks being halted or severely restricted,” she added.

The Commissioner also argued that claiming rights before the United Nations or other international bodies does not constitute an act of terrorism, citing advocating for women’s rights in the occupied Palestinian territories and providing legal aid to detained Palestinians.

She stressed that those actions are not acts of terrorism while pointing to the obvious: The Israeli occupation did not present any evidence to support its allegations against the NGOs, nor did it conduct a public process to establish the accusations.

This research note discusses that the Turkish businessman Kavala has been in prison for four years for his suspected role in the Gezi Park protests and his involvement in a failed coup attempt in 2016. Kavala is one of Turkey’s most well-known civil society figures. Since the early 1980s, the billionaire has helped to establish multiple publishing enterprises in Turkey, and a decade later, he has supported numerous civil society organizations. 

Osman Kavala was one of Turkey’s most prominent activists. He has been held in pre-trial imprisonment in Silivri Prison since October 2017. Authorities in Turkey accuse him of initiating the Gezi Park demonstrations in 2013.

Significantly, President Erdogan has accused him of being the Turkish leg of billionaire US philanthropist George Soros, whom he claims is behind insurgencies in several nations. He has been held in detention pending the outcome of his latest trial, and he has rejected the charges. 

Whereas, the indictment of September 2020, according to Kavala’s lawyers, was nothing more than a presumed fantasy based on no real evidence. Human rights organizations around the world have slammed Kavala’s arrest, claiming the charges are politically motivated. Additionally, the European Court of Human Rights (ECHR) found that Kavala’s arrest was politically motivated and it was carried out with the goal of “bringing other human rights defenders, to the political prisoners.” (DW, 2021).

Following a similar line, the Council of Europe has given a warning to Turkey to comply with a European Court of Human Rights ruling to free Kavala pending trial, which was issued in 2019. Otherwise, it will file an infringement complaint against Turkey.

The ambassadors of the ten nations issued a unified statement urging Turkey to abide by the Council of Europe’s judgments. Germany, Canada, Denmark, Finland, France, the Netherlands, New Zealand, Norway, Sweden, and the United States all requested a “fair and swift” settlement to Kavala’s case (DW, 2021).

They further stressed, “The ongoing delays in Kaval’s trial, which include the merging of many cases and the establishment of new ones following a prior acquittal, throw a pall over Turkish court respect for democracy, the rule of law, and transparency. In light of the European Court of Human Rights’ judgment, they requested Turkey to release it as soon as possible. These ambassadors  demanded a fair and expeditious settlement to his case under Turkey’s international responsibilities and domestic legislation.”

Most importantly, Kavala who has been imprisoned since 2017, has been frequently demanded their release by international observers and human rights organizations. They claim that the detention is due to political concerns. While the officials deny the allegations and maintain that Turkish courts are independent.

While the Turkish government views the ambassadors’ declaration as direct involvement in domestic politics. Turkish President Recep Tayyip Erdogan condemned the diplomats’ behavior and threatened to expel them from the country. In an intensifying disagreement with the countries, who intervened in the case of a detained businessman by demanding his release.

After their statement demanding the release of Osman Kavala, President Erdogan authorized the Turkish foreign minister to proclaim the ambassadors of ten nations to Turkey “persona non grata”. Notably, when a diplomat is declared persona non grata, they are banned in their host country and they are now just one step away from expulsion.

In a speech, Erdogan remarked, “I have directed our foreign minister to expedite the declaration of these ten ambassadors,” These ten ambassadors must be declared persona non grata. They will be familiar with and understand Turkey”. He went on to say that these ambassadors would not release “terrorists” in their nations if they did not know and understand them (Arab News, 2021).

For this reason, tensions between Ankara and the United States, Canada, Germany, France, the Netherlands, Denmark, Sweden, Finland, Norway, and New Zealand soared over  Turkey’s president proclaimed the envoys “persona non grata.”

Moreover, the ambassadors had been instructed to “keep within the responsibilities of their duties after an insincere and double-standard approach and It was highlighted in our constitution that Turkey is a democratic state of law that protects human rights, and it was reminded that such reckless utterances would not affect the Turkish court”.

The government further noted that the European Court of Human Rights (ECtHR) judgments are frequently disregarded and not followed, claiming that focusing solely on Turkish cases to keep the Kavala case on the table at all times is ineffective (DW, 2021).

Whereas, former Turkish ambassador to Azerbaijan and senior fellow at the Carnegie Endowment in Washington, Alper Coskun, tweeted, “Expelling ambassadors is not a good strategy to protect national interests. Turkey’s Planned Expulsion Of 10 Western Ambassadors Is A Huge Diplomatic Move

Simply denouncing them but declining to take any tangible action would have made President Erdogan look weak in everyone’s eyes unless they recanted their joint statement and apologized. He couldn’t afford to do that even though he must also have expected that Western pressure against him personally and his country more broadly will soon intensify as a result.

Turkish President Erdogan announced over the weekend that he instructed his Foreign Minister to declare 10 Western ambassadors persona non grata after they meddled in his country’s foreign affairs by releasing a joint statement demanding the release of a jailed businessman who they consider to be a “political prisoner”. This is a huge diplomatic move that will reverberate for some time to come. It shows that Turkey has zero tolerance for such high-profile foreign meddling and is ready to accept the potential political consequences for expelling the Canadian, Danish, Dutch, Finish, French, German, New Zealander, Norwegian, Swedish, and US Ambassadors.

Those diplomats must have predicted that the Turkish President would react in a similar way to how he ultimately did. This implies that they planned their joint statement as a political provocation intended to catalyze a self-sustaining cycle of escalations between their countries and Turkey. The purpose of doing so is to prompt the pretext for intensifying their information warfare against him and potentially threatening sanctions, whether on that basis or a different one.

Those diplomats’ countries probably also wanted to manipulate their people’s perceptions about Turkey by making it seem like it’s “anti-Western” and “despotic”. The planned expulsion of so many ambassadors of such influential countries will certainly provoke a diplomatic crisis. It’ll likely generate incredibly hostile coverage by the Western Mainstream Media too. In other words, all of this is part of the US-led Hybrid War on Turkey which aims to punish the country for its increasingly independent foreign policy in recent years.

From the Turkish perspective, it’s unacceptable to let those diplomats meddle in such a blatant way, especially regarding a jailed figure who they consider to be a “political prisoner”. Simply denouncing them but declining to take any tangible action would have made President Erdogan look weak in everyone’s eyes unless they recanted their joint statement and apologized. He couldn’t afford to do that even though he must also have expected that Western pressure against him personally and his country more broadly will soon intensify as a result.

From a larger viewpoint, Turkey is setting an example for other non-Western nations to follow. Not all of them are as confident as that country is nor might they have the “Democratic Security” capabilities to adequately defend themselves from the predicted intensification of US-led Hybrid Wars against them under such pretexts, but they might still be inspired by this huge diplomatic move. After all, a pivotal pillar of Turkish foreign policy is to present itself as a model for others to emulate, especially in the Global South and most recently in Africa.

Looking forward, Turkish-Western relations will likely continue to deteriorate. There’s a chance that the ambassadors who Turkey plans to expel might eventually return or be replaced after some time, but that probably won’t happen in the near future if the country does indeed go through with what its leader just threatened. The overall impact of this trend will be to accelerate Turkey’s proactive engagement with its new non-Western partners, with a priority given to Russia and China.

That development could be manipulated through information warfare means to reinforce the false narrative that Turkey is “anti-Western” even though it would just be pragmatically reacting to Western political provocations. Nevertheless, closer Turkish ties with Russia and China could fuel the intensification of the US-led Hybrid War against it through geopolitical fearmongering about that country’s grand strategic intentions. For this reason, Ankara must brace itself for myriad destabilization attempts ahead of the summer 2023 elections.

It’s impossible to predict the exact forms that they could take at this moment, but they’ll likely be comprehensive and thus involve economic, information, political, and perhaps even security plots. President Erdogan is increasingly portrayed by the Western Mainstream Media as a so-called “rogue” leader, the misleading perception of which will be exploited to intensify the US-led Hybrid War. He’s unlikely to capitulate to their political demands related to his foreign policy but he’s likely still interested in bargaining with them.

سهيل عبود وطارق البيطار يشعلان الشارع وسط غليان طائفي: انفجار يهدّد الحكومة وخراب يهدد البلاد

لا يبدو أن هناك عاقلاً يمكنه التحكم بأفعال المحقّق العدلي طارق البيطار. الرجل فقد عقله، ويتصرف وكأن وحياً نزل عليه للقيام بما يخلّص البلاد، ويتصرف بلامبالاة مطلقة، ليس إزاء الآراء المنتقدة لسلوكه القضائي فحسب، بل وأيضاً تجاه القضاء نفسه، ويبدي ثقة عمياء بأن أحداً من القضاة لن يجرؤ على المسّ بموقعه.

أكثر من ذلك، يراهن البيطار ندماءه، من إعلاميين وناشطي جمعيات، على أن ما من أحد في لبنان قادر على تنحيته أو إجباره على التنحي، وأنه سيستمر في استدعاء كل من يعتقد أنه يجب أن يخضع له، بما في ذلك أرفع السياسيين… فكيف إذا ما حظي بمباركة ممثل الإله البطريرك الماروني بشارة الراعي، وضمانة المرشح الفرنسي لرئاسة الجمهورية رئيس مجلس القضاء الأعلى سهيل عبود، وحصانة في لبنان وخارجه توفّرها له دول عدة من أميركا إلى فرنسا وبريطانيا.

المشكلة أن البيطار ليس وحده في هذا المسار غير العقلاني في إدارة ملف قد يقود البلاد ليس إلى تعطيل الحكومة، وإنما إلى حرب أهلية حقيقية. بل معه فريق يضم قضاة كباراً – بينهم من يجلس في مجلس القضاء الأعلى – ممن يلهجون بـ«حصانة القضاء»، وهم الذين يدينون للسلطة السياسية في وصولهم إلى مناصبهم. كما أن إلى جانبه كل الفريق السياسي المعارض للمقاومة، من أحزاب وشخصيات و«صيصان سفارات» منتشرين على شكل فطريات تسمي نفسها «المجتمع المدني». ومعه، أيضاً، فريق إعلامي تديره السفارات الأميركية والفرنسية والإماراتية والسعودية. وهاجس هؤلاء جميعاً هو السير في تحقيق قضائي غامض وإجراءات ملتبسة تهدف إلى واحد من أمرين:

إما القبول بوجهة البيطار التي تستهدف، عملياً، فريقاً سياسياً بعينه.
أو تجهيل الحقيقة وترك اللبنانيين رهينة حرب الإشاعات التي يريد الأميركيون وفريقهم في لبنان استثمارها في الانتخابات النيابية المقبلة.

يحصل ذلك، وسط سجال يراد أن يكون له بعده الطائفي. إذ تسود البلد مناخات تريد اعتبار المشكلة القائمة اليوم بين مسيحيين ومسلمين. ولا يقتصر الأمر على الشعارات والمواقف، بل يشمل ترهيب الجسم القضائي والسياسي والأمني، بما في ذلك إثارة مناخات طائفية بقصد إحراج قوى حليفة للمقاومة، ولا سيما التيار الوطني الحر وتيار المردة.

من جانب الثنائي الشيعي، كان قرار الطلب من الحكومة بت الأمر قبل بحث أي عنوان آخر، مدخلاً لنقاش يستهدف وقف التسييس، لا التدخل في تعيين قضاة أو تنحيتهم. حتى أن الرئيس نبيه بري أبلغ وزير العدل هنري خوري، أمس، أن المخرج المطلوب هو توفير ضمانة بأن يحترم المحقق العدلي الدستور والقوانين لا أن يتجاوزها، سائلاً إياه: «كيف يعقل إدارة ملف بهذه الحساسية، من دون أن تكون هناك هيئة قادرة على مساءلة هذا القاضي، في وقت يتجاوز أبسط القواعد الدستورية ويفرض نفسه فوق سلطة المجلس النيابي؟».

وقد زار وزير العدل أمس بري ورئيس الحكومة نجيب ميقاتي، ساعياً باسم الرئيس ميشال عون إلى إيجاد مخرج يضمن وضع ضوابط توقف مخالفات البيطار، وتحول دون تعطيل الحكومة، خصوصاً بعدما قرّر وزراء تحالف حزب الله – أمل – المردة تعليق مشاركتهم في جلسات الحكومة في حال رفضت البت بالأمر. فيما جرت على الهامش اتصالات لمعالجة مسألة شكلية تتصل بامتعاض رئيس الجمهورية من طريقة تحدث وزير الثقافة محمد مرتضى في جلسة أول من أمس، وهو أمر تمت معالجته مع استمرار تفويض الثنائي الشيعي لمرتضى التحدث باسمه في أي جلسة للحكومة تعقد لمعالجة الملف.

الفريق المتضرر من أداء البيطار مستعد للذهاب إلى أبعد الحدود ولن يقف عند خاطر أحد


المؤشرات السياسية توحي بمناخات سلبية، لكن أحداً لا يتحدث عن أبواب موصدة، لأن عدم معالجة المشكلة سيتسبّب ليس فقط بتعليق عمل الحكومة بل في تعطيلها، ما ينعكس سلباً على البلد كله، لأن عدم قدرة الحكومة على معالجة ملف متفجّر وحساس، يعني أنها لن تكون قادرة على حسم أي ملف. ويدرك رئيس الحكومة أن الاعتراض سيطيح أي توافق على قضايا شديدة الحساسية هي موضع نقاش الآن، من مشروع استجرار الغاز المصري والسؤال عما يثبت أنه ليس إسرائيلياً، إلى ملف المشكلة المالية ومصير رياض سلامة وضرورة تصفية المصارف المتسببة بسرقة ودائع الناس ومحاكمة المسؤولين عنهم، إلى ملف ترسيم الحدود البحرية الذي تريد الولايات المتحدة علاجاً سريعاً له، وصولاً إلى الملف الأكثر حساسية المتعلق بالاتفاق على التفاوض مع صندوق النقد الدولي الذي لن يمر من دون اتفاق، ولو اقتضى الأمر هزة شعبية كبيرة جداً في البلاد، مع رفض مسبق لكل أفكار ميقاتي حول رفع الضرائب وتقليص القطاع العام وإعادة فتح ملف الخصخصة وحتى التفكير في استخدام الذهب أو تسييله لسداد الدين الخارجي قبل الداخلي…
الفريق المتضرر من أداء البيطار مستعد للذهاب إلى أبعد الحدود، ولن يقف عند خاطر أحد هذه المرة. هذه هي الأجواء التي تسود ليس قياداته فقط، بل قواعده التي تعيش تعبئة غير مسبوقة. وكل المناقشات أمس انتهت إلى الاتفاق على عدم القيام بتحرك يتسبب بذعر كبير، والاقتصار على تحرك «رمزي» و«أولي» أمام قصر العدل، بمشاركة بضعة آلاف من الطلاب والنقابيين، يتقدمهم حقوقيون سيدلون بتصريحات ذات طابع قانوني يفنّد مخالفات المحقق العدلي.
في الجهة المقابلة، ووسط مخاوف من حصول مواجهات على الأرض، وبعدما تدارست قوى الفريق الآخر الأمر، وبسبب خشية المجموعات المدنية من عدم قدرتها على توفير حشد مناسب، وحصول انقسام بين أهالي الضحايا، ورفض كثيرين الدعوات إلى حراك شعبي تتزعمه القوات اللبنانية التي عملت وحداتها الحزبية على إطلاق النفير في الأشرفية وفرن الشباك وعين الرمانة… أتت «التعليمات» بالتراجع والعمل على بديل بالدعوة إلى إضراب عام، باعتبار أن تحركاً من هذا النوع قد يجد تجاوباً ولا يقود إلى مواجهة قد تأخذ البلاد إلى تطورات «ليست في حسابات السفارات»، على حد تعبير مسؤول أمني بارز أبدى خشيته من عدم قدرة القوى الأمنية والعسكرية على ضبط الأمر في حال التصعيد على خلفيات طائفية، وذلك بعدما بدأت مجموعات تابعة للقوات اللبنانية عمليات تعبئة في عدد من المناطق وحركة رفع للصلبان في مناطق عدة في بيروت وتوزيع رسائل صوتية تدعو إلى الاستعداد للمواجهة. علماً أن نائب القوات عماد واكيم نفى لاحقاً أي تحرك لعناصر القوات اللبنانية في الأشرفية.
في سياق الاتصالات، يبدو أن الأمر يحتاج إلى نقاش جدي مع الرئيسين عون وميقاتي، خصوصاً أن الأخير أظهر تفهماً لإيجاد مخرج في جلسة أول من أمس. ونُقل عنه تلقيه اتصالات «خارجية» تحذره من مغبة «الوقوع تحت ضغط حزب الله واستفزاز مشاعر الناس»، فيما سادت الأوساط الحزبية القريبة من الرئيس عون مناخات تدعو إلى التنبه من أن الأخذ بمطالب الفريق المتضرر قد تنعكس سلباً على قواعد التيار في خضم التحضير للانتخابات النيابية المقبلة.

تعليمات لداعمي البيطار بعدم الذهاب إلى مواجهة قد تأخذ البلاد إلى تطورات «ليست في حسابات السفارات»


الرئيس عون استقبل موفدين شرحوا له حقيقة موقف الثنائي الشيعي، وقيل له صراحة إن حزب الله وحركة أمل ليسا في صدد إحراجه أو الضغط عليه أو على رئيس الحكومة. لكن الأمر لا يتعلق بحسابات موضعية، بل بموقف حاسم من قضية قد تقود البلاد إلى انفجار يطيح الحكومة ويعطّل ما تبقّى من ولاية العهد بصورة نهائية، ويترك الشارع لحالات شعبوية ستصيبه قبل غيره.

وسمع الرئيس عون والنائب جبران باسيل أنه لا يمكن الامتناع عن القيام بخطوة تعالج الأزمة بحجة عدم المساس بالقضاء، كما أنه لا يمكن التعامل مع هذا الملف بازدواجية، فيكون عون هو رئيس جلسة مجلس الدفاع الأعلى الذي يمنع ملاحقة اللواء طوني صليبا، بينما يدعو باسيل إلى رفع الحصانات عن الآخرين من وزراء ونواب.

رئيس الجمهورية الذي لا يريد أن تذهب البلاد إلى مواجهة مدمرة، ويعرف جيداً حقيقة الموقف الحاسم لحزب الله على الأقل، بادر إلى ورشة اتصالات، بدأت بالاتفاق مع الرئيس ميقاتي على تأجيل جلسة أمس، والطلب إلى وزير العدل زيارة مرجعيات لمناقشتها في المخارج الممكنة، والبحث في طريقة التعامل مع مجلس القضاء الأعلى، وخصوصاً رئيسه الذي صار الجميع يتعامل معه أخيراً على أنه بوجهين: يقول للوزير شيئاً، ويقول للقاضي البيطار شيئاً آخر. ووصل الأمر بجهة سياسية مسيحية بارزة إلى مصارحة عبود بأنه قد يكون مسؤولاً عن التجييش الطائفي وحتى عن عملية ترهيب للقضاة، وسأله زواره: «ما هي الأسباب التي تجعلك تختار قضاة من طائفة معينة لتولي دراسة طلبت الرد أو كف يد المحقق العدلي، وأنت تعلم أنهم عرضة لضغط على خلفية طائفية؟». علماً أن عبود نفسه كان لجأ مرات عدة إلى البطريرك الماروني لبحث الأمر نفسه، ناهيك عن أنه ينسق خطواته مع جهات غير لبنانية يعرف مسبقاً أن لديها برنامجاً يقتصر على بند واحد: ضرب المقاومة!

عملياً، تدخل البلاد اليوم مرحلة جديدة من المواجهة السياسية على خلفية ملف تفجير مرفأ بيروت. ويبدو أن بين القوى السياسية والشخصيات المعنية بالملف من لم يفهم جيداً واقع الأمور في البلاد اليوم، ومن ضمنها القوى التي تحرص على الظهور بمظهر «الحياد»، كالحزب التقدمي الاشتراكي الذي يمضي رئيسه وليد جنبلاط إجازة في الخارج. إذ إنه أعطى الضوء الأخضر لنواب في كتلته باستخدام الملف للهجوم على الرئيس عون وحزب الله في سياق التعبئة الانتخابية. واللافت، هنا، أن جنبلاط يتجاوز للمرة الأولى حليفه الرئيس بري الذي سيكون أبرز المتضررين من كل هذا الملف.


المفتي والبطريرك والتحقيقات


وعد البطريرك الماروني بشارة الراعي وفداً من دار الفتوى، ضمّ الشيخ خلدون عريمط والباحث محمد السماك وآخرين بأن يعرض وجهة نظر المجلس الشرعي الإسلامي من ملف التحقيقات في مرفأ بيروت على مجلس المطارنة في أقرب فرصة من أجل العمل لمنع تفاقم الخلافات السياسية التي تأخذ طابعاً طائفياً.

وكان المفتي عبد اللطيف دريان قد أوفد الى الراعي من يشرح له خطورة ما يجري في ملف التحقيقات، ويسلّمه نسخة عن موقف المجلس الشرعي. ويجري الحديث عن موقف متوقع لدار الإفتاء متابعة لقرار المجلس الشرعي، وخصوصاً بعدما برزت مواقف خجولة للقيادات السياسية التي تدور في فلك الدار، وبعدما ران الصمت على موقف الرئيس سعد الحريري ونادي رؤساء الحكومات الذين يبدو أنهم يراعون متطلبات التعبئة الخاصة بالانتخابات، علماً بأن هناك احتقاناً في بعض أوساط دار الفتوى من أداء بكركي، وخصوصاً بعدما تبيّن أن إدارة الدار كانت قد طلبت من المشرفين على احتفال 4 آب الماضي التنسيق لحضور ديني مشترك، وأن لا يقتصر الأمر على قدّاس حتى لا يبدو وكأن الجريمة تستهدف طائفة دون أخرى. إلا أن الدار لم تتلقّ أي جواب من دوائر بكركي.


مجلس النواب: تحرك لاستعادة الصلاحية

وجّهت الأمانة العامة لمجلس النواب كتاباً الى وزارة الداخلية والبلديات، أشارت فيه إلى أنه «لما كان المجلس النيابي قد أبلغ النيابة العامة التمييزية بواسطة وزارة العدل ولأكثر من مرة موقفه من ملاحقة الرؤساء والوزراء يعود الى المجلس النيابي والمجلس الأعلى لمحاكمة الرؤساء والوزراء وفقاً للمواد ٧٠ – ٧١ و٨٠ من الدستور، ولما كان المجلس قد باشر السير بالإجراءات اللازمة في ما يتعلق بجريمة انفجار مرفأ بيروت، ولما كان هذا الأمر لا يعود اختصاصه للقضاء العدلي، وبالتالي فإن أي إجراء من قبله يتعلق بأحد الرؤساء والوزراء والنواب يعتبر تجاوزاً لصلاحيته».

وبحسب المعلومات، فإن «مجلس النواب بصدد التحضير لجلسة مستقلة يكون ملف المرفأ البند الوحيد على جدول أعمالها، على أن يعاد طرح كتاب المحقق العدلي السابق فادي صوان، باعتباره كتاباً قائماً».

وكان صوان قد طالب المجلس باتخاذ ما يراه مناسباً بشأن مسؤولية وزراء عن إهمال «ما» ساهم في وقوع انفجار المرفأ. ورأى صوان يومها في رسالته، أنه بعد أشهر من حصول التفجير، لم يقُم البرلمان بأي دور. وقال إنه بناءً على التحقيقات التي أُجريت، «ربما تكون هناك شبهة إهمال» من قبل مسؤولين ووزراء تعاقبوا على وزارات المالية والأشغال والعدل، وأن على مجلس النواب «القيام بما يراه مناسباً وفق مادتين من الدستور». الأولى هي المادة 70 التي تنص على أن «لمجلس النواب أن يتهم رئيس مجلس الوزراء والوزراء بارتكابهم الخيانة العظمى أو بإخلالهم بالواجبات المترتبة عليهم، ولا يجوز أن يصدر قرار الاتهام إلا بغالبية الثلثين من مجموع أعضاء المجلس»، والثانية المادة 71 التي تنص على أن «اﻟوزﯾر اﻟﻣﺗﮭم يُحاكم أﻣﺎم اﻟﻣﺟﻟس اﻷﻋﻟﯽ لمحاكمة الرؤساء والوزراء».

لكن مصادر متابعة لاحظت أن خطوة المجلس النيابي قد تحافظ على فكرة الاستنسابية في حال قررت حصر الدعوى بالأسماء الذين ادّعى القاضي البيطار عليهم، وبالتالي صار واجباً على رئيس المجلس إيجاد المخرج الذي يجعل الادّعاء أو المحاكمة تشمل كل مسؤول تعاقب على المواقع الرئيسية المعنيّة بالملف، من رؤساء للجمهورية والحكومة وجميع وزراء الوصاية المختصين من دون استثناء.


دياب عاد الى بيروت


عاد الرئيس حسان دياب إلى بيروت مساء أمس بعد زيارة عائلية للولايات المتحدة استمرت نحو شهر. ومعلوم أن هناك مذكرتي إحضار أصدرهما في حقه المحقق العدلي القاضي طارق البيطار، وقد دان الأمين العام لحزب الله السيد حسن نصرالله في كلمته الأخيرة استقواء البيطار على رئيس الحكومة السابق.


مخارج للنقاش والبيطار على موقفه


بحسب المعنيّين، فإنّ المخارج التي جرى التداول بها حتى مساء أمس لم تتجاوز فكرة التوافق على آليّة لا تحقق هدف وقف الاستنسابية، ما استدعى مزيداً من البحث وتأجيل جلسة الحكومة أمس. وكان الجميع يترقّب قرار رئيس محكمة التمييز القاضي ناجي عيد بشأن الدعوى الجديدة لرد القاضي البيطار. إلا أنه لم ينجح في عقد جلسته أمس لعدم توفر النصاب بسبب غياب العضو رنا عويدات التي يعتقد أنها ستعلن اليوم تنحّيها عن القضية. وسط أجواء توحي بأن عيد، بضغط من رئيس مجلس القضاء الأعلى سهيل عبود (المرشح الفرنسي لرئاسة الجمهورية)، يستعد لإصدار قرار برد طلب المدعى عليهم.

ومعلوم أن هناك ثلاث دعاوى مقدمة ضد البيطار أمام محكمة التمييز، ارتياب مشروع ودفوع شكلية وطلبات رد. ولذا يجب أن يكون هناك قضاة قادرون على اتخاذ موقف جريء، بدل التهرب من المسؤولية بحجة عدم الصلاحية. وفي هذا الإطار، علمت «الأخبار» أن الوزير علي حسن خليل الذي صدرت في حقه مذكرة توقيف غيابية قد يتقدم في اليومين المقبلين بطلب أمام الهيئة العامة لمحكمة التمييز لتحديد الجهة القضائية التي لها صلاحية البتّ بالدعاوى المقدّمة ضد البيطار.

الى ذلك، طُرح على وزير العدل هنري خوري الطلب الى مجلس القضاء إعادة النظر في تكليف القاضي البيطار وتسمية خليفة له، أو تقديم ضمانات لاحترام الآليات القانونية والدستورية لمنع التورط في أي استثمار سياسي للملف. ومع ضعف الثقة برغبة عبود القيام بذلك، طرح مخرج آخر قد يكون صعب التحقيق، وهو مبادرة مجلس الوزراء الى استرداد الملف من أصله من المجلس العدلي وإحالته الى محاكم أخرى تحترم أصول المحاكمات والاختصاصات.
